New Unit vs Expansion: How Subsidy Schemes Define Them
New unit or capacity expansion? How to read a state subsidy scheme's eligibility definitions, the 25% gross block test, same-premises rules and a worked example.

In this article (10 sections)
Whether your project is a new unit or an expansion is decided by the definitions clause of the scheme you apply under, not by how you describe it. A new unit is usually one that starts commercial production during the scheme's operative period with fresh investment. An expansion is an existing unit that adds investment, and often capacity, above a minimum threshold, usually at the same premises. Read four things in the definition: the threshold, the premises rule, the base it is measured against, and the anti-reconstruction clause. The examples below are from official Uttar Pradesh and Gujarat documents, as of November 2026.
Where to find the definitions
Every state industrial or MSME policy has a definitions section, usually near the start of the Government Resolution or policy, and implementation guidelines that add detail. Look for these terms:
- New enterprise / new unit
- Existing enterprise
- Expansion, diversification, sometimes modernisation or forward/backward integration
- Gross fixed capital investment or gross block
- Eligible fixed capital investment (the part on which the subsidy is calculated)
- Date of commencement of commercial production
- Operative period and eligible investment period
Guidelines matter as much as the resolution. Gujarat's draft guidelines for its 2022 MSME scheme, for instance, add rules on where an expansion can happen and when a trading unit becomes a new unit.
How two states define it
| Point | Uttar Pradesh MSME Promotion Policy 2022 | Gujarat MSME scheme 2022 (draft guidelines) |
|---|---|---|
| Expansion threshold | Gross block up by at least 25% and production capacity up by 25%, through fresh capital investment | Defined in the resolution; the guidelines add location rules |
| Different premises | Not addressed in the policy text we reviewed | Expansion or diversification at other premises must apply as a new unit |
| Trading or services starting manufacturing | Not addressed in the policy text we reviewed | Treated as a new unit |
| Size category for incentives | Policy defines MSME categories | Based on plant and machinery in the proposed project, but total plant and machinery of all the enterprise's Gujarat units must not exceed ₹50 crore |
| Benefits to expansion | Same facilities as new units "under certain terms and conditions" | Expansion eligible, for example for interest subsidy |
Both documents are official, but read the current version of your own state's resolution and any amendments before relying on them.
Worked example: does a ₹40 lakh line qualify?
An existing manufacturer in Uttar Pradesh has a gross block (original cost of fixed assets before depreciation) of ₹2 crore and an installed capacity of 1,000 tonnes a month. It plans a new line costing ₹40 lakh, financed by a term loan, that adds 300 tonnes of capacity.
| Test (UP-style, both required) | Calculation | Result |
|---|---|---|
| Gross block increase | ₹40 lakh ÷ ₹2 crore = 20% | Fails (needs 25%) |
| Capacity increase | 300 ÷ 1,000 = 30% | Passes |
| Both together | Not an expansion under this test |
If the line cost ₹50 lakh (₹50 lakh ÷ ₹2 crore = 25%) with the same 300-tonne capacity addition, both tests would pass. The fix is not to inflate the invoice: it is to plan the project scope against the definition before ordering, and to check which assets count. Land, used machinery or items bought before the operative period may not count towards the increase.
Then check the financing: a ₹50 lakh term loan at an illustrative 10% for 5 years means an EMI of about ₹1,06,235. Test your own numbers in the EMI calculator.
What the base and benefit are measured on
- Base for the threshold: usually gross block or gross fixed capital investment before expansion, certified by a chartered accountant. Application forms commonly ask for this certificate.
- Benefit base: expansion incentives are typically calculated on the additional eligible investment, while a new unit's incentive uses its whole eligible fixed capital investment.
- Eligible investment period: UP's policy allows 2 years from application for micro, 3 for small and 4 for medium enterprises, and production must start within that period.
- Commencement date: for an expansion, the scheme may use the date the expanded capacity starts commercial production, not the unit's original start date.
Anti-reconstruction clauses
Schemes for new units often exclude units formed by splitting, reconstructing or transferring an existing business. Setting up a new company in the same shed, with the same machinery and customers, usually does not make it a new unit. If you genuinely start a separate project, keep separate premises, assets, power connection and books. For how entity type interacts with these rules, see business structure and state scheme eligibility.
Documents checklist
- CA certificate of gross block or gross fixed capital investment before the project
- Installed capacity before and after, with a chartered engineer's certificate where asked
- Project report and bank sanction letter
- Invoices, payment proof and machine serial numbers for new assets
- Udyam certificate and GST registration showing the premises
- Proof of commencement of commercial production for the new capacity (first sale invoice, power consumption)
- Previous subsidy sanctions for the same unit, if any
Questions to ask the DIC or scheme office
- Does my project meet the expansion definition, and on which base figure?
- Is expansion at a new site allowed, or must I apply as a new unit?
- Which assets count towards the threshold, and which are excluded?
- From which date does the benefit period start for the expansion?
- Can I claim both under this scheme and another state or central scheme for the same assets?
Common mistakes
- Measuring against net block. Most definitions use gross block or gross investment; using depreciated values makes the increase look larger than the scheme will accept.
- Missing the "and". A test with both investment and capacity conditions fails if either one falls short.
- Buying machinery before applying. See machinery before subsidy approval for the timing rules.
- Choosing the wrong form. Applying as expansion for a different site where the scheme wants a new-unit application delays the claim.
If your classification is disputed
- Ask the DIC for the decision in writing, quoting the definition it applied.
- Submit certified gross block and capacity figures and request a review.
- Escalate to the state industries or MSME commissionerate and the state grievance portal; use CPGRAMS at pgportal.gov.in for central schemes.
- If your bank delays certificates needed for the claim, complain to its grievance officer and, after 30 days without a satisfactory reply, to the RBI Integrated Ombudsman at cms.rbi.org.in.

Key takeaways
- The scheme's definitions clause and guidelines decide whether you are a new unit or an expansion.
- UP's 2022 MSME policy needs a 25% rise in gross block and 25% in capacity for expansion.
- Gujarat's draft guidelines treat expansion at other premises, and trading units starting manufacturing, as new units.
- In the example, a ₹40 lakh line on a ₹2 crore gross block (20%) failed the test; ₹50 lakh (25%) passed.
- Expansion benefits are usually calculated on the additional investment only.
Frequently asked questions
What is the difference between a new unit and an expansion in a subsidy scheme?
A new unit is usually an enterprise that starts commercial production during the scheme's operative period with fresh investment. An expansion is an existing unit that adds investment and capacity, usually at the same premises, above a minimum threshold set in the scheme. Each scheme defines both terms in its own definitions clause.
How much must investment increase to qualify as expansion?
It depends on the scheme. Uttar Pradesh's MSME Promotion Policy 2022, for example, treats a unit as expansion or diversification if it increases its gross block by at least 25% and its production capacity by 25% through fresh capital investment. Other states set their own tests.
Is expansion at a new location treated as expansion?
Not always. Gujarat's draft guidelines for its 2022 MSME scheme say expansion or diversification at premises other than the existing one will not be treated as an expansion unit and must apply as a new unit.
Can a trading business that starts manufacturing claim as a new unit?
Under Gujarat's draft guidelines for its 2022 MSME scheme, an enterprise engaged in trading or services that starts manufacturing is considered a new unit. Other states may word this differently, so check your scheme.
Is subsidy for expansion calculated on the whole investment?
Usually not. Expansion incentives are typically calculated on the additional eligible investment made for the expansion, not on the unit's earlier assets. A new unit's incentive is calculated on its whole eligible fixed capital investment.
