If you move your factory after applying for a state subsidy or a subsidy-linked loan, tell the scheme office and your bank before you shift, then update Udyam, GST, labour and pollution approvals, the power connection and insurance for the new address. Many state schemes tie the incentive to the location and premises named in your application, so a move can change your rate, turn an "expansion" into a "new unit" or break a continuous-production condition. Rules differ by state; the examples below are from official scheme documents and are as of November 2026.

Why location matters to a subsidy

Scheme element How a move can affect it Where to check
Area-based rate Many policies grade talukas, districts or regions; a new site may carry a different rate or period Location or category annexure of the state resolution
Same-premises rules Gujarat's draft guidelines for its 2022 MSME scheme say expansion at other premises must apply as a new unit Definitions of expansion and new unit
Continuous production Gujarat's draft guidelines flag units that stop production for more than six months (seasonal units excluded) Lock-in and continuous-production clause
Land-linked benefits Stamp duty relief is usually tied to the land bought for that project Stamp duty clause and recovery conditions
Bank security Machinery and stock are hypothecated at a stated address Sanction letter and hypothecation deed

A shift is not automatically fatal. What hurts is moving first and telling people later, because inspections compare the address on the claim with the address where the assets actually are.

Before you move: three conversations

1. The scheme office (District Industries Centre or state portal). Write a short letter with the claim number, the old and new addresses, the reason and the planned date. Ask:

  • Does the claim continue at the new site, or must I re-apply?
  • Which rate and period apply if the new site is in a different category?
  • Does the shutdown period count against the continuous-production condition?
  • Will assets already claimed need re-verification at the new site?

2. Your bank or lender. Ask for written consent to move hypothecated machinery and stock, and whether it needs a site inspection, a fresh valuation or revised insurance. If you are a company and the charge documents describe the location, ask whether a modification of charge has to be filed with the Registrar of Companies.

3. The insurer. Insurance usually covers assets at a named location. Gujarat's draft guidelines ask for a valid insurance policy for machinery, building or shed at the time of a claim, so the cover should show the new address.

Records to update after a move

Record Where Notes
Subsidy application or sanction DIC or state portal (for example Gujarat's IFP portal) Written intimation and, where required, prior approval
Udyam registration udyamregistration.gov.in Update the plant location; keep the old and new addresses on file
GST registration GST portal, Form GST REG-14 Core-field amendment, generally within 15 days of the change, approved by the officer
Factory registration or licence State labour department The OSH Code, 2020 replaced the Factories Act, 1948 from 21 November 2025; state rules decide the procedure, so check your state's portal
Pollution consent State Pollution Control Board A new site usually needs fresh Consent to Establish and Consent to Operate
Power connection Electricity distribution company New connection or shifting; keep receipts if a scheme reimburses connection charges
Fire NOC, trade or shop licence Local body and fire department Requirements depend on the city and activity
Import Export Code, if you export DGFT portal Update the address so shipping documents match
Bank records and insurance Branch and insurer Hypothecation address, stock statements, policy schedule

Worked example: ₹60 lakh term loan, different area category

A small manufacturer applies for a state interest subsidy on a ₹60 lakh term loan at an illustrative 10% for 7 years. The EMI is about ₹99,607 (check yours in the EMI calculator). Total interest over 7 years is about ₹23.67 lakh.

Suppose, for illustration only, the original site is in an area where the scheme gives 7 percentage points of interest subsidy for 7 years, while the new site in a city area gets 5 percentage points for 5 years. The real rates and caps come from your state's resolution.

Original site (illustrative 7% for 7 years) New site (illustrative 5% for 5 years)
Year-1 interest on reducing balance ₹5,71,944 ₹5,71,944
Year-1 subsidy 7 ÷ 10 × ₹5,71,944 ≈ ₹4,00,361 5 ÷ 10 × ₹5,71,944 ≈ ₹2,85,972
Total subsidy ≈ ₹16,56,898 ≈ ₹10,67,499
Difference ≈ ₹5.89 lakh less

The move did not make the unit ineligible, but if the scheme re-rates it to the new location, the benefit falls by almost ₹5.9 lakh. That is the number to weigh against the savings in rent or logistics before you shift.

There can be smaller gains too. Gujarat's draft guideline for assistance for power connection charges under the 2022 MSME scheme covers charges paid for a new connection, additional load or shifting of a connection or service line, at 35% up to ₹5 lakh during the policy period, for units outside GIDC or approved industrial parks, if you apply within one year of paying the charges. On ₹3,00,000 of non-refundable shifting charges, that would be ₹1,05,000.

Documents checklist

  • Intimation letter to the DIC or scheme office, with acknowledgement
  • Bank's written consent to move hypothecated assets
  • Ownership deed or registered or notarised rent agreement for the new premises
  • Updated Udyam certificate and GST registration certificate
  • New or amended factory registration, pollution consents and fire NOC
  • Asset list with invoice numbers and machine serial numbers, matched to the subsidy claim
  • Insurance policy showing the new address
  • Proof of the date production stopped and restarted (electricity bills, sales invoices)

What to ask the bank or agency

  • Is prior consent needed, or only intimation, and within how many days?
  • Will a site inspection or fresh valuation be done, and at whose cost?
  • Do sanction terms or interest rates change if the collateral or location changes?
  • Will the subsidy claim, interest certificate or no-dues letter show the new address?

Common mistakes

  • Moving first, writing later. Inspectors find the machinery at a different address and treat the claim as doubtful.
  • Calling a move "expansion". If you add capacity at a new site, some schemes treat it as a new unit with its own application.
  • Forgetting the continuous-production clock. A long shutdown during the shift may need to be explained in writing.
  • Leaving GST at the old address. E-way bills and invoices then do not match the plant, which raises questions at subsidy inspection and loan renewal.
  • Not updating insurance. A fire at the new site with the policy still showing the old address can lead to a disputed claim.

If something goes wrong

  1. Ask the DIC for any rejection or rate change in writing, with the clause it relies on.
  2. Escalate to the state industries or MSME commissionerate and the state's grievance system.
  3. For central scheme components, use CPGRAMS at pgportal.gov.in.
  4. If the bank delays consent or certificates needed for the claim, complain to its grievance redressal officer; if there is no satisfactory reply in 30 days, file with the RBI Integrated Ombudsman at cms.rbi.org.in (for RBI-regulated lenders).

If you bought machinery before the scheme's approval, the conditions in machinery before subsidy approval still apply after the move. For how area categories work in one state, see the Gujarat MSME interest subsidy guide.

Key takeaways

  • Tell the scheme office, bank and insurer before you move; get answers in writing.
  • A new site can change your area category, rate and period, or turn expansion into a new-unit application.
  • Update Udyam, GST (REG-14, generally within 15 days), labour registration, pollution consent and power connection for the new address.
  • In the illustrative ₹60 lakh example, a lower-category site cut the interest subsidy by about ₹5.9 lakh.
  • Keep proof of when production stopped and restarted, and a matched asset list, for inspection.

Frequently asked questions

Can I move my factory after applying for a state MSME subsidy?

Usually yes, but tell the District Industries Centre or scheme office in writing before you move and ask whether the claim continues. Many schemes link the benefit to the location and premises in the application, so a move can change the rate, the category of the claim or the eligibility itself.

Does moving the factory change my subsidy rate?

It can. Many state policies set rates by taluka, district or zone. If the new site falls in a different category, the scheme may apply the new site's rate or ask you to re-apply. Check the location clause in your state's resolution.

How soon must I update GST after shifting the factory?

A change in the principal or additional place of business is a core-field amendment filed in Form GST REG-14, generally within 15 days of the change, and it needs approval from the tax officer. Keep the new premises' ownership or rent documents ready.

Do I need to tell the bank before shifting a factory?

Usually yes. Machinery and stock are typically hypothecated to the bank at a stated address, so most sanction letters require prior consent or intimation before moving them. The bank may inspect the new site and update its security records and insurance.

Will expansion at a new site count as expansion?

Not always. Gujarat's draft guidelines for its 2022 MSME scheme say expansion or diversification at premises other than the existing one is not treated as an expansion unit and must apply as a new unit. Other states have their own rules.
