Name Mismatch in Sale Deed and Home Loan Papers: Fix It
Name spelt differently in your sale deed, KYC and loan papers? Find which document to correct, how a rectification deed works and how to write to your lender.

In this article (8 sections)
If your name reads "Sunita R. Patel" in the sale deed, "Sunita Rameshbhai Patel" in Aadhaar and "Sunita Patil" in the loan agreement, first find which document is wrong and which one is the reference. Your PAN and Aadhaar should be correct first; then fix a clerical error in the registered sale deed with a registered rectification deed, explain a genuine name change with a marriage certificate, gazette notification or a "one and the same person" affidavit, and finally ask your lender in writing to correct the loan records to match.
This guide walks through each type of mismatch, the correction route for each document, and a ready-to-use letter to your lender. It is general information as of October 2026; stamp duty, fees and sub-registrar procedures vary by state, so confirm locally or with a property lawyer.
Why a name mismatch matters
A home loan connects three sets of records, and all three must point to the same person:
- Identity (KYC): PAN, Aadhaar and other officially valid documents that the lender verifies.
- Title: the registered sale deed or conveyance deed, the encumbrance certificate from the sub-registrar, and municipal or revenue records.
- Loan: the sanction letter, Key Facts Statement, loan agreement, mortgage documents and the charge the lender registers with CERSAI, the central registry of security interests.
A mismatch can lead to:
- Disbursement held because the lender's legal team cannot confirm that the borrower owns the property being mortgaged.
- Trouble at resale, when the buyer's lender questions the title chain.
- Problems releasing documents after closure, when the no-dues certificate and returned deeds must match. Our loan closure checklist covers that stage.
- Mutation and tax records that do not match, causing delays in property tax or utility transfers.
Common mismatches and the usual fix
| Mismatch | Example | Usual fix |
|---|---|---|
| Spelling error in sale deed | "Patil" for "Patel" | Registered rectification deed |
| Initials vs full name | "S. R. Patel" vs "Sunita Rameshbhai Patel" | Notarised "one and the same person" affidavit with ID proofs; some lenders may still ask for rectification |
| Name changed after marriage | Maiden name on deed, married name on loan | Marriage certificate, gazette notification if formally changed, updated PAN/Aadhaar |
| Error only in loan papers | Deed and KYC correct, sanction letter wrong | Written request to lender for corrected documents |
| Error in KYC | PAN and Aadhaar spellings differ | Update PAN/Aadhaar first, then other records |
| Co-owner missing on loan | Deed in two names, loan in one | Lender usually asks all co-owners to join as co-borrowers or give consent |
Step-by-step: preparing your correction request
Step 1: Fix the identity documents first
Decide the correct full name and make sure PAN and Aadhaar match it. Lenders verify KYC against these, and every other correction will be compared with them. If you also need to update your bank KYC, see our guide to bank KYC update.
Step 2: Correct the sale deed through a rectification deed
If the registered deed itself has a clerical error, the standard route is a rectification deed (sometimes called a correction deed):
- A lawyer drafts a deed referring to the original document's registration number and date, stating the error and the correct entry.
- All parties to the original deed sign it: the seller and buyer, or their legal heirs.
- It is registered at the same sub-registrar office where the original was registered, with ID proofs and witnesses as per local practice.
- Stamp duty and registration fee depend on the state. In several states a purely clerical correction costs only a nominal amount, but if the correction changes the area, value or property description, duty on the difference can apply.
A rectification deed can only fix genuine errors. It cannot change the substance of the sale, such as adding a new buyer. If the seller refuses or cannot be traced, the remedy is a civil suit for rectification under Section 26 of the Specific Relief Act, 1963, which takes much longer.
After registration, ask for a fresh encumbrance certificate; it should show the rectification deed against the property.
Step 3: Use an affidavit or certificate for genuine name changes
If the deed was correct when made but your name has since changed, rectification is usually not needed. Instead, collect:
- a notarised "one and the same person" affidavit on stamp paper listing every version of your name;
- a marriage certificate, where relevant; and
- a gazette notification if you formally changed your name.
Step 4: Ask the lender to correct the loan records
Submit a written request with copies of the corrected KYC, the rectification deed or affidavit, and the encumbrance certificate. Ask the lender to:
- correct the name in the loan account and agreement, usually through a letter or supplementary document;
- update the mortgage records and the CERSAI charge; and
- confirm in writing once done.
If the loan is not yet disbursed, ask whether the lender will reissue the sanction letter and KFS in the correct name. Charges for this should be as disclosed in your KFS or schedule of charges.
Step 5: Update municipal and revenue records
Apply for mutation or correction in property tax and revenue records with the rectification deed or affidavit, so all records match before you sell or refinance.
Worked example: the cost of waiting
Sunita has bought an under-construction flat for ₹60 lakh with a ₹45 lakh loan. Her registered agreement for sale spells her surname "Patil", while her PAN, Aadhaar and loan application say "Patel". A ₹30 lakh builder demand is due, but the lender's legal team has held disbursement until the error is fixed.
Under Section 19(7) of the RERA Act, a buyer who delays a payment due under the agreement can be charged interest at the rate in the state rules. Many states use SBI's highest MCLR plus 2%; assume 10.7% here (illustrative).
| If disbursement is delayed | Calculation | Interest the builder may charge |
|---|---|---|
| 45 days | ₹30,00,000 × 10.7% × 45 ÷ 365 | ₹39,575 |
| 60 days | ₹30,00,000 × 10.7% × 60 ÷ 365 | ₹52,767 |
A rectification deed for a spelling error usually costs a small fraction of this, plus a lawyer's drafting fee. Sorting the name before the demand arrives is far cheaper than paying delay interest. To see what the eventual EMI looks like once disbursement resumes, use the EMI calculator.
Sample letter to your lender
To: The Branch Manager / Loan Servicing Team, [Lender name, branch]
Subject: Request to correct borrower name in home loan account no. [XXXX]
My name appears as "[name in loan records]" in the sanction letter and loan agreement for the above account. My correct name, as per PAN and Aadhaar, is "[correct name]". The title deed has been [corrected by a rectification deed registered on [date] at [sub-registrar office] / supported by the enclosed affidavit].
Enclosed: self-attested PAN, Aadhaar, [rectification deed / affidavit / marriage certificate / gazette notification], and the latest encumbrance certificate.
Please correct my name in the loan account, agreement and mortgage records, including the CERSAI record, and confirm in writing within [15] days. If any further document is needed, please tell me in writing.
[Name, mobile, email, date]
Send it by email to the lender's official ID and keep the acknowledgement. Use only contact details from the lender's official website or your sanction letter.
What not to do
- Do not use an affidavit to "fix" a wrong name inside the deed if the lender's lawyer asks for rectification; it can stall disbursement again later.
- Do not sign a fresh deed that changes area, price or parties under the label of rectification; that can attract full stamp duty and dispute.
- Do not pay "agents" who promise to change records without your presence at the sub-registrar office.
- Do not share OTPs or net banking details with anyone helping you with paperwork.
Where to complain
If the lender does not act or demands charges not disclosed in your KFS, write to its grievance redressal officer. If unresolved after 30 days, banks and NBFCs can be taken to the RBI Integrated Ombudsman at cms.rbi.org.in. For housing finance companies, use the National Housing Bank's GRIDS portal (grids.nhbonline.org.in). For sub-registrar issues, approach the District Registrar or your state's registration department. Planning a loan? Our home loan eligibility and documents guide lists what lenders check.
Key takeaways
- Fix PAN and Aadhaar first; every other record is checked against them.
- Clerical errors in a registered deed are fixed by a rectification deed signed by all original parties at the same sub-registrar.
- A genuine later name change needs proof (marriage certificate, gazette, affidavit), not rectification.
- Ask the lender in writing to correct loan, mortgage and CERSAI records.
- A ₹30 lakh payment delayed 45 days at 10.7% can cost about ₹39,575 in interest, far more than a timely correction.
Frequently asked questions
How do I correct a spelling mistake in my registered sale deed?
Through a rectification deed signed by all parties to the original deed and registered at the sub-registrar office where the original was registered. It can fix clerical errors such as a misspelt name but cannot change the basic terms of the sale.
What if the seller refuses to sign the rectification deed?
A rectification deed needs the original parties or their legal heirs. If a party refuses or cannot be traced, you may need to approach a civil court for rectification under Section 26 of the Specific Relief Act, 1963. Take legal advice before deciding.
Is a one and the same person affidavit enough for a home loan?
For small differences such as an initial versus a full name, many lenders accept a notarised affidavit with supporting ID proofs. For a wrong name in the title deed itself, most lenders' legal teams ask for a registered rectification deed before disbursement.
My name changed after marriage. Do I need to rectify the sale deed?
Usually not. The deed was correct when registered. You prove the link with a marriage certificate, a gazette notification if you formally changed your name, and updated PAN and Aadhaar, and inform your lender and the municipal records.
Can a name mismatch stop my home loan disbursement?
Yes. Lenders check that the borrower, the KYC and the title deed refer to the same person before creating the mortgage. A mismatch the legal team cannot explain can hold up disbursement until it is corrected.
Where do I complain if the lender does not update my name?
Write to the lender's grievance redressal officer. If not resolved within 30 days, complain to the RBI Integrated Ombudsman at cms.rbi.org.in for banks and NBFCs, or to the National Housing Bank's GRIDS portal for housing finance companies.
